1. What is Due Process of Law and how does the Constitution protect the “rights of the criminally accused”? After explaining these rights, consider the recent arrest of the Boston Marathon Bombing suspect, Dzhokhar Tsarnaev, and the FBI’s decision to withhold his Miranda Rights for 48 hours. Make an argument as to whether you think this decision and the overall handling of his case violates his constitutional rights. Should there be exceptions to these rights in cases with extenuating circumstances? Explain.
