Fashion is sometimes considered too utilitarian to be able to impose intellectuall property rights upon.How does the innability to copyright textile colour and patterns affect the fashion world. What are the advantages and disadvantages and who benefits?

 
Currently there is no copyright law that helps designers patent colour patterns or new design styles. That is why we increasingly Gucci and LV bags completley covered by their trademark all over their bags and other products, because the trademark is the only think that you can protect.

This is why we also see frake brands with the same desing but changed names like Abbibas instead of Addidas.

Please talk about the advantages of having a (if there was a law which didnt cosider fashion too utilitarian) copyright for designers and people that buy these designs.

for the people – they wouldnt get ripped off for buying what they believe to be real brands and they instead buy cheap knock offs

for the designers – incentive to innovate as none witll copy them
– they make more profit because anyone using their design have to pay them a royalty fee or licence
– designers will get the credit they deserve for starting a trend

and then move on to disscusing what life is like in reality and how does having no copyright really affect the fashion world? Does it really make designers lose money since high street retailers copy them and pay no tax and does it make them not want to innovate?

actually you will argue that for designers its even more benefitial because

1- they need to innovate even more to stay ahead from the people that copy them and in fact their innovations are becoming too hard to copy…this is why we are seeing fashion designs moving into the fine line between fashion and art. (include exaples lile lady gaga wearing a dress made out of meat or metal)

2- they make more money because their trends gets spread around faster and they essentlly get more free advertisment

finally say that even if copyright was able to be imposed, like it is in japan and france, it wouldnt be that effective and use france, japan or other countires that you can reserach to show why.
