Your Client is undecided as to which contract to utilise on a large mixed use development including public and private funding. They have been debating the use of NEC3

and JCT SBC 2011 and have requested you Provide a critically analysis of the major differences between the two contracts. You should clearly define the difference

between the two forms of contract and discuss possible impacts on the development processes.

Credit will be given for argument supported by reference to relevant clauses from the Conditions of Contract. Credit will not be given for copying out clauses from the

Conditions of Contract without evidence that you understand their relevance to the problem under consideration.
