Guidance for the essay
STUDENTS BEWARE!

This question is very open, but it is not as simple as it appears.  We want you to think very, very carefully about how you intend to approach your essay.

Consider the first lecture and the introductory chapters in your textbooks.  You are aware of how the Crusades saw knights travelling away from their property for

perhaps years.  You know that the idea of the trust began because the knights needed someone to look after their property on their behalf while they were away.

You will have read about how tax could be avoided by the Use, and about the development of the equitable jurisdiction leading up to the Judicature Acts.  You will

invariably have come across the maxims of equity.

So when writing your essay:
1.    DO NOT give us a 3500 word history lesson on the above points.  A simple regurgitation of how equity and the trust developed is not an acceptable answer to the

2.    DO NOT just list the maxims of equity and explain what they are.  We know what the maxims are and how they work.  We expect much more from you than this;
3.    DO NOT just list a few cases that are vaguely on the topic of equity generally;
4.    DO NOT just rely on textbooks and your lecture notes.  We will know if you have done this as your bibliography will be poor to non-existent, and your essay

will be basic, descriptive and sound very familiar to us;
5.    DO read widely around the topic and THINK about the answer you are writing.
6.    Remember that yes, we have googled it already.  We will know if you rely solely or mainly on searches like this.
Your word limit is 3500 words and that includes the annotated bibliography. There is no set length for your bibliography, but we would suggest that it does not in

total amount to more than 600 words maximum.  This means that you will need to be very selective in the sources you choose to look at and use for your essay.

The annotated bibliography
An annotated bibliography is a list of sources that you have found during your research, that you have read and you have concluded are relevant to help you answer the

question.  An annotated bibliography provides a full citation for the sources and then provides at the very least a couple of sentences explanation of how the source

was useful to you in answering the question.

Some general guidance:

•    DO NOT just provide a very long list of various sources just because you think it looks impressive.  You have a strict word limit so be focused on sources that

you have actually read and that will help you.

•    For EACH source you cite you must say exactly why you used it /did not use it and exactly how you found it did or did not assist with your arguments.

•    DO NOT just repeat in your bibliography what you may have said in the main essay with regard to your sources.  In the bibliography you should be explaining why

you have used the source, and not just repeating what the source has said that supports your arguments (or not).

•    DO refer to academic articles and books (scholarly books please and not just textbooks!)

•    DO NOT forget to add a case list if you cite cases, and online references if you use web-based sources.  You still need to briefly explain why these sources

were or were not helpful.

•    Please use footnotes and not endnotes.  Footnotes do not count towards the word limit but do not try to use them inappropriately in order to circumvent the

word limit.  If you use excessive and inappropriate footnotes you will be marked down.
