Legal Environment of Business

Legal Environment of Business

Project description
Scenario: After graduating from college four years ago, Charles Bingley was hired by a Fortune 500 company—Pemberley, Inc. Charles’ work ethic and dedication to the company earned him a promotion to Senior Purchasing Agent for one of Pem-berley’s regional offices. As Senior Purchasing Agent, Bingley is currently in the process of buying furniture for ten executive offices in Pemberley’s northeast re-gional office building. The offices are being remodeled and if Bingley does a good job, he hopes to be asked to make similar purchases for Pemberley’s six other re-gional buildings.

After some research, Bingley has resolved on purchasing the furniture from one of two finalist companies. Both furniture dealers provided good warranty language, reasonable shipping prices, and personal service. Although the local dealer price is slightly more expensive, the purchase price from either company will be in excess of $250,000.

To clarify some last minute details, Mr. Bingley calls the local dealer. During the conversation, Bingley happens to mention that he is currently remodeling a room in his own home to use as a home office. Toward the end of the conversation, Bingley is surprised when the local dealer offers to provide Bingley with a new desk, chair, and file cabinet for the home office at no cost.

Bingley ultimately decides that the quality of the furniture from the local dealer is su-perior and enters into a contract. Bingley was not swayed by the offer of a desk, chair, and file cabinet and can support his purchase decision adequately.

Should Bingley accept the furniture for his home office—why or why not?

Paper Instructions: This assignment requires that you Read Chapter 2 of your textbook and the Code of Conduct from Pemberley, Inc. (which is identical to the Code of Conduct adopted by Coca-Cola and found at http://assets.coca-colacompany.com/45/59/f85d53a84ec597f74c754003450c/COBC_English.pdf) (The Code). Pay particular attention to information in the text or provisions of the Code that relate to conflicts of interest and/or gifts.

Is there any guidance available to Bingley in Chapter 2 of the textbook, or the Code, that would assist Bingley in making a decision? Explain.

Is it a violation of ethics for Bingley to purchase the furniture from the local dealer and accept the furniture for his home office? If so, what, if any, sanctions are identi-fied in the Code for such a violation.

Your written response to this Ethics issue should be between two and three pages, no longer. Simply providing your opinion is not sufficient. You must provide refer-ences to support your conclusion and citations to Chapter 2 of the textbook and the Code are required for those references. Paraphrasing concepts requires a textbook or code reference and exact language requires both quotation marks and textbook or Code references.

This assignment will be graded on both content and writing. The content will be as-sessed based upon specific application of the relevant reading materials. Writing will be evaluated in terms of organization, accuracy, clarity of expression, spelling, grammar, attribution and citation and, finally, professionalism.
