You are employed by Tuff Pty. Ltd. a construction company. Your company’s Commercial Manager, Vesta, receives the following letter:

Dear Sir/Madam,

It is the intention of Janus Pty. Ltd. to award a contract to your company, Tuff Pty. Ltd. to build a factory including production, stores, offices and canteen

facilities to be built in four continuous phases- all to be subject to obtaining agreement on the land and leases with the Development Corporation, full building and

bye-law consent and the site investigation…. the whole to be subject to agreement on an acceptable contract. We authorise you to start work immediately, in order to

meet our completion date of the first phase by 1 July 2012.

Advise Vesta whether or not the company may have any legal problems if it starts work immediately based on this letter, and how they may be addressed.
