Spring 2015 Research Paper (100 points)
This is a quasi individual assignment. You may discuss your thoughts and research on this case with others (in fact, I would encourage it), but you must outline, develop and write the paper on your own, individually. Your paper, a hard copy due in class Monday, April 13, 2015, should not exceed five pages. If you think you need more than five pages to complete the assignment, consider this quote from Mark Twain: “I didn’t have time to write a short letter, so I wrote a long one instead.”

On July 1, 2014, the United States Supreme Court (USSC) granted certiorari in Reed v. Town of Gilbert. On January 12, 2015, around the same time we were in class, the USSC heard oral argument in the case. The written (and Audio) transcript of the argument is available on supremecourt.gov (scroll down to January 12th and find the case name under Recent Arguments). In addition, with a little research, the U.S. District Court of Arizona February 2011 and Ninth Circuit Court of Appeal November 2009 and February 2013 opinions can be found online.

After reading these opinions (most importantly, the February 2013 opinion from the Ninth Circuit) and the January 12th USSC oral argument transcript, write your research paper. What are the relevant facts in this case? What are the issues? Do you thinkthisa First Amendment Freedom of Speech or Freedom of Religion Issue? What rules apply? Analyze the issue(s) you have identified and reach a conclusion in this case. The USSC will release their opinion in the case this spring.
