the city and two firefighters are appealing the March 21, 2011 decision of the Ohio Court of Appeals, 5th District (Stark County) in Anderson v. City of Massillon, 193 Ohio App.3d 297, 2011-Ohio-1328, which held that they should not be dismissed from lawsuit filed by estate of 72 year old driver and his 4 year old passenger, killed on the morning of May 6, 2008 in a collision with the aerial.
