Your client, Rusty Nail, purchased a vehicle from a local new car dealer. Ever since he drove the vehicle off the lot, it has had a foul odor coming from the engine. Rusty has taken the new car back to the dealer at least nine times, and each time, the dealer drains a pan under the air conditioning unit and tells Rusty that this should take care of the problem, and he will not have any problems. Each time, the smell returns within three weeks. Rusty is beside himself. The smell has become so bad that he has to wear a breathing mask and he won?t let other passengers ride in the car when it smells. The car has 17,000 miles on it, and he has come to the attorney for whom you work to find a solution.
